Human Rights and Justice in Islam

Islam gave mankind an ideal code of human rights fourteen centuries ago. These rights aim at conferring honour and dignity on mankind and eliminating exploitation, oppression and injustice. Human rights in Islam mean that God has granted these rights. The first thing we find in Islam in this connection is that it lays down some rights for man as a human being. In other words, it means that every man whether he belongs to this country or that, whether he is a believer or unbeliever. The first and foremost basic right is the right to live and respect human life. Allah says:

وَلَا تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ ۗ وَمَن قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا فَلَا يُسْرِف فِّي الْقَتْلِ

“Do not kill the soul which Allah has made sacred except by right of justice. Whoever is killed unjustly, We have given his heir authority, but let him not exceed the limits in taking life.” (Surat Al-Isra 17:33)

All human beings are born free and equal in status and respect. Human rights are the basic rights that belong to everyone, from birth to death. In Islam, human rights are an integral part of the overall Islamic order, and all Muslim governments and organs of society must implement them in letter and spirit within the framework of that order. Justice before the law is to be strictly impartial without regard to religion, race, position, wealth or any other.

وَفِيْٓ اَمْوَالِهِمْ حَقٌّ لِّلسَّاۤىِٕلِ وَالْمَحْرُوْمِ

“And in their wealth, there is an acknowledged right for the needy and destitute.” (Surat Adh-Dhariyat 51:19)

Human rights in Islam are firmly rooted in the belief that God, and God alone, is the Law Giver and the Source of all human rights. Due to their Divine origin, no ruler, government, assembly or authority can curtail or violate in any way the human rights conferred by God, nor can they be surrendered. The Quran puts the highest emphasis on the importance of acquiring knowledge. Allah created man in the best and most perfected form ever.

Human rights are rights that humans have in their nature, here are some rights:

  5. Human rights lead to a balanced way of living
  6. Human rights are to know the purpose of life

  9. Human rights enrich respecting parents
  10. Human rights earning an honest living
  11. Human rights taking care of orphans
  12. Human rights put your trust in God
  13. Human rights speaking the truth
  14. Human rights provide for all family
  15. Human rights have a noble purpose 
  16. Human rights standing up for justice
  17. Human rights kindness to neighbours
  18. Human rights to personal responsibility
  19. Human rights to protection of reputation
  20. Human rights mean everything is from God
  21. Human rights to participate in public affairs
  22. Human rights to struggle for just social order
  23. Human rights to enjoin virtue and eradicate evil
  24. Human rights intimate next life as well as our faith
  25. Human rights recall  God’s Mercy and fear of punishment

Islam has laid down universal and fundamental rights for humanity as a whole, which are to be observed and respected under all circumstances. Islam rejects certain individuals or nations being favoured because of their wealth, power, or race.  God created human beings as equals who are to be distinguished from each other only based on their faith and piety. Unfortunately, human rights are being trampled upon with impunity in many countries of the world, including some Muslim countries.

Islam provides many human rights for an Individual:

  • Right to Freedom: Islam has strictly forbidden the fundamental practice of conquering a free man and making him a slave or selling him into slavery.
  • The right of Equality among Human Beings: Islam recognizes the principle of absolute equality between men irrespective of colour, race or nationality. Racism is not allowed in Islam.
  • Right to Equal Justice: Islam is the religion of peace and Justice.
  • The right of Honor and Respect: Islam protects honour, in Islam insulting others and making fun of them is not allowed whether a person is a believer or non-believer.
  • Right to Basic Necessities of Life: Islam emphasizes helping the poor and needy who need your help if you are more fortunate.
  • Rights to Privacy: It is a basic right of every citizen that his private life should be respected. He must enjoy moments of privacy at his home.
  • Right to Life: The first and the most important basic human right is the right to live and respect human life.

The significance of Human Rights according to the Quran:

  • “Men not created without a purpose.” (Quran 23:115)
  • “Man is accountable for his actions.” (Surah Al-Isra, 17:1)
  • “Men not created without a purpose.” (Surah Muminun, 23:115)
  • “And the Hereafter is better for you than the first life.” (Quran 93:4)
  • “you have that day, nor for you will there be any denial.” (Quran 42:47)
  • “Do not let your hatred of a people incite you to aggression.” (Quran 5:2)
  • “The life of this world is merely the enjoyment of delusion.” (Quran 3:185)
  • “I have not created men except that they should serve Me.” (Quran, 51:56)

Islam declares all people equal in terms of human values, and all individuals are equal before the Islamic code of law.  Its judgments and legal penalties apply to all races and classes of people without any distinction, and without any person, group or nation acquiring immunity or privilege.

Purpose of Life According to Islam:

  • Life is a Test: “He who created death and life to test you as to which of you is best in deed-and He is the Almighty, the Oft-Forgiving.” (Al-Mulk 67:2)
  • Life is Momentary: The life that is currently lived on this earth will not last forever. It is only a momentary thing. “O, my people! This life of the world is only a (passing) enjoyment, and surely the hereafter is the abode to settle.” (Al-Mu’Min 40:39)
  • Life in Heaven Will Be Better: That’s why it’s not good to only care about the materialistic things that exist in this life.
  • Dutiful Worship: Muslims always remember Allah. This can be done by carrying out all the dutiful worship.
  • Live According to the Rules of Islam: When a Muslim is willing to dedicate oneself to Allah, then they must live according to the rules of Islam.
  • Life Motivation: If a Muslim doesn’t know what their life goal is then they could lose the motivation to carry on with life.
  • Live Life in Kindness: A Muslim must always remember to be kind while living on earth. Every living and non-living thing is Allah’s creation and one should try to be kind to them all.

This life is an ultimate testing ground and although we cannot control everything that happens to us, we can control how we react. Islam encourages a person to focus on what is in their control, to be grateful to God for blessings, and to be patient during hardships. Allah says:

إِنَّكَ لَا تَهْدِي مَنْ أَحْبَبْتَ وَلَٰكِنَّ اللَّهَ يَهْدِي مَن يَشَاءُ وَهُوَ أَعْلَمُ بِالْمُهْتَدِينَ

“Verily, you do not guide whom you love, but Allah guides whom He wills. He is most knowing of the rightly guided.” (Surah Al-Qasas 28:56)

Islam requires that Muslims possess upright character and deal justly with the entire human race, irrespective of their ethnicity, nationality, and creed. Human life is a complete ideology that deals with the fundamental problems of life based on sensorial observations. This world is no more than a test in which all humans are bound to face hardships and challenges that reveal their patience and steadfastness. Man faces many things in life and with none of them can he deal properly unless he forms an opinion about the nature or condition of that thing and his relationship with it. Problems and troubles serve as means to expiate sins and elevate the believer’s rank in the Hereafter. Allah Says:

وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَىٰ ۖ وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ

“Cooperate in righteousness and piety, and do not cooperate in sin and aggression.” (Surat Al-Ma’idah 5:2)

In life, we encounter problems as we breathe. But it doesn’t get to us until we feel a major impact, and that’s when it becomes a source of concern, hurt, or sorrow. Life problems, depending on their magnitude, can be clogs in the wheel of progress, and we may not be able to attain our full potential if we don’t learn to place our problems in the proper perspectives.  We must come to know our Creator, Sustainer, and Ultimate Judge. May Allah guide us all to the right path and help us in earning good deeds and may He forgive our past sins.
